ABUJA – Senator Ned Nwoko (APC, Delta North) has intensified his legal challenge against former Delta State Governor, Senator Ifeanyi Okowa, by vowing to appeal the Federal High Court’s decision striking out his suit challenging Okowa’s senatorial candidacy.
The lawmaker disclosed this in a statement issued by his legal team, describing the court’s ruling as unfortunate and expressing confidence that the Court of Appeal would overturn the decision.
According to Nwoko, the suit was struck out rather than dismissed, insisting that the substantive issues raised in the case were yet to be determined by the court.
“We have instructed our counsel to file an appeal immediately and are confident that the appellate court will overturn it,” the senator stated.
Nwoko argued that the ruling was not based on the merits of the case, maintaining that the court had earlier granted him leave to amend his originating processes before later setting aside the order on its own motion.
He described the development as unjustified, alleging that it amounted to an attempt to frustrate the substantive suit before it could be heard.
“This is an attempt to sabotage the substantive suit at this preliminary stage, and it is imperative that the suit be heard on its merits,” he said.
The senator reaffirmed his determination to pursue the appeal to its logical conclusion, stressing that the legal action was aimed at ensuring that justice is done and seen to be done.
He also reiterated his commitment to equity, transparency, party unity and the continued progress of Delta State.
