The Speaker of the Delta State House of Assembly, Rt. Hon. Emomotimi Dennis Guwor, has asked the Delta State High Court, Oleh Judicial Division, to strike out a suit he described as “frivolous” and “baseless” filed by two Isoko lawyers, Ejumejowo Anthony, Esq., and Dr. Oke Michael Aziakpono.

Through his counsel, Dr. Ayo Asala, SAN, the Speaker, alongside the Delta State House of Assembly, filed a counter-affidavit challenging the originating summons in Suit No: HCO/M/16/2025, in which the applicants had dragged the Attorney-General, Commissioner of Finance, the Assembly, and the Speaker to court over the passage of the Delta State 2025 Appropriation Bill.

The applicants allege irregularities in the passage of the bill and question the allocation of infrastructure projects.

But in his response, Dr. Asala maintained that the Appropriation Law was duly passed with a two-thirds majority, is a public document accessible to all, and guides lawful government expenditure.

He dismissed claims that Isoko South and North LGAs were excluded from infrastructure allocations, listing ongoing projects in the areas, including works at Southern Delta University, Edherie-Ase Road, Okpolo-Enhwe Road, and Uzere-Asaba-Ase Roads and culverts.

The respondents further stressed that the legislature acted independently, free of coercion, and in line with the government’s MORE Agenda for statewide development.

They argued the suit lacks locus standi, discloses no reasonable cause of action, and raises no constitutional question warranting the court’s interpretation.

“It is in the interest of justice to dismiss this suit,” Dr. Asala urged, describing the applicants’ case as an abuse of court process.
