APGA Drags Delta APC To Court Over Unlawful Conduct Of Party Primaries

The All Progressives Grand Alliance (APGA), Delta State chapter has dragged the State chapter of the All Progressives Congress (APC) to Court for unconstitutional conduct of her primaries which produced Senator Ovie Omo-Agege as the governorship candidate and others in the 2023 general election.

The plaintiffs, AGPA, Mr. Jeckins Ejiro Wiske, Mr. Alina Harrison Akporhogho and Mr. Emuobonuvie Obukowho are challenging the defendants, the Independent National Electoral Commission (INEC) and the APC that the latter did not serve INEC the stipulated 21 days notice to conduct the party primaries.

Today, Wednesday, July 20, 2022 in the Federal High Court of Nigeria, in the Asaba Judicial Division, Holden at Asaba, sat to hear the suit between All Progressives Grand Alliance (APGA), Mr. Jeckins Ejiro Wisikie & 2 Ors and Independent National Electoral Commission (INEC) & All Progressives Congress (APC); with Suit No.: FHC/ASB/CS/147/2022.

The Plaintiffs (APGA, Jeckins & 2 Ors) are contending that APC did not give twenty one days notice to INEC for the conduct of the Ad-hoc delegates elections before it (APC) went ahead to purportedly conduct its Party primary elections for State House of Assembly, House of Representatives, Senate and governorship, as required by Section 82 (1) of the Electoral Act 2022 (as amended).

Also, it (APC) failed to clearly outlined in its Party Constitution and guidelines, the procedure for the democratic elections of delegates that purportedly voted at its rescheduled Party primary elections held on the 26th, 27th & 28th May, 2022 respectively, in accordance with Section 84 (8) of the Electoral Act 2022 (as amended).

Consequently, pursuant to Section 82 (5) and 84 (13) of the Electoral Act 2022 (as amended), the Plaintiffs is seeking a declaration that the Court should nullify the purported list of All Progressives Congress (APC) nominated candidates for  State Houses of Assembly for the twenty nine Constituencies; candidates for House of Representatives for the ten Federal Constituencies; candidates for the three Senatorial Districts and the candidate for governorship, for the 2023 general elections.

The next adjourned Court sitting is September 14, 2022.

It would be recall that the APC conducted its primaries on 25th May 2022, the permanent site, Federal College of Education (Technical), Asaba, the state capital.
