Court Prevent Inspector General Of Police, Delta Police Commissioner From Arresting, Detaining Governorship Hopeful

A Federal High Court sitting in Abuja, has granted an order restraining the Inspector-General of Police (IGP), Muhammed Abubakar Adamu and the Delta State Commissioner of Police (CP), Mohammed Hafiz Inuwa, from apprehending and detaining Olorogun Kenneth Gbagi, a governorship hopeful in Delta State.

In an exparte motion filed by Gbagiā€™s lawyer, Nkem Okoro, on Monday September 28, 2020, prayed the court to restrain the Inspector-General of Police (First Respondent) and the Delta State Police Commissioner (2ndĀ respondent) or their agents from arresting him.

The Order was granted by the Honourable Justice Taiwo O. Taiwo of the Federal High Court Abuja, in a suit marked: FHC/ABJ/CS/1267/2020, on Wednesday 30th September 2020.

A copy of the motion exparte granted by the Court on Wednesday 30th September 2020, stated thus: ā€œThat Order of Interim is hereby made restraining the Respondents, whether by themselves, their agents, employees, or by whatever name called, from threatening to arrest and or detain, and/or from arresting and detaining the Applicant pending the hearing and determination of the Applicantā€™s application for the enforcement of his fundamental rights

ā€œThat Leave is hereby granted to the Applicant to serve Originating processes and all other subsequent processes in this matter, on the 2ndĀ Respondent by substituted means.

ā€œThat Order is hereby made by this Honourable Court directing that the Originating Processes and all other subsequent processes in this matter be served on the 2 Respondent by substituted means to wit:

ā€œ(a) By serving the 2 Respondent, through the 1ā€³ Respondent, the Inspector General of the Police, at the office of the Inspector General of Police, Force Headquarters, Louis Edet House, Area 11, Garki, Abuja. 4.

ā€œThat the Respondents are at liberty if they wish to tie their response jointly and/or severally within 14 days”.

The case was adjourned by Honourable Justice Taiwo, to 16th October, 2020 for hearing.

The governorship hopeful while fielding questions from journalists, had promised to answer invitation if invited by the police during the World Press Conference held in Oginibo country home, Ughelli south local government area of the state

It would be recall that the police had declared Olorogun Kenneth Gbagi wanted for allegedly refusing to honour invitation for questioning over allege stripping of four of his staff naked over missing N5, 000 belonging to his Signatious Hotel.
