In a surprising turn of events, the Delta State Traffic Management Authority (DESTMA) has issued an official statement clarifying serious misinterpretations surrounding a recent court judgment.
The Delta State High Court in Warri delivered a ruling in Suit No. W/348/2016: Chuks Christian Ofili v. The Attorney-General of Delta State & Delta State Traffic Management Authority, which has sparked controversy following a media publication.
DESTMA expressed concern over the circulation of this publication, which it claims misrepresents the scope, intent, and legal implications of the court’s ruling.
The judgment focuses on Section 18(1) of the Delta State Traffic Management Authority Law, 2013, specifically addressing the issue of administrative fines and penalties being imposed without the oversight of a competent court of law.
In its statement signed by Chris Okinedo, in behalf of Director-General of DESTMA, the agency categorically denied narratives suggesting the court abolished the authority or invalidated its statutory duty to regulate traffic, enforce laws, and maintain road safety across Delta State.
Instead, the court emphasized the necessity for fines and penalties to be imposed by a court of competent jurisdiction, in alignment with both constitutional provisions and due process.
“DESTMA operates strictly within the framework of the law,” the statement read.
“Traffic offenders are lawfully charged and brought before competent courts, including Mobile Courts, for proper adjudication and subsequent fines.”
The authority reassured the public of its adherence to legal standards and guidance, reiterating its commitment to professionalism and constitutional compliance in its operations.
“Members of the public are advised to disregard misleading interpretations suggesting that DESTMA lacks legal authority or operates outside constitutional bounds,” the statement concluded.
