The trial of Chief Michael Nwaukoni, the Iyase of Ogwashi-Uku, and four others over allegations of terrorism, attempted murder, and malicious damage was stalled once again on Wednesday at the Federal High Court in Asaba due to the absence of the prosecution team.
The delay occurred despite the case having been rescheduled under Suit No. FHC/ASB/18C/24, and follows a pattern of adjournments that have hampered progress in the high-profile matter.
The latest development may be linked to the ongoing nationwide strike by the Judiciary Staff Union of Nigeria (JUSUN), although sources indicate that members of the prosecution team had previously arrived in Asaba in anticipation of the trial’s commencement.
Presiding over the matter, Justice Olufunmilola Agbaje adjourned proceedings to July 23, 2025, directing that all relevant court documents be served on both prosecution and defence teams ahead of the next hearing date.

During the brief proceedings, Senior Advocate of Nigeria, Efe Akpofure, counsel to the fifth defendant, Chief Nwaukoni, made an oral application for bail. Justice Agbaje, however, declined the request, ruling that the administrative bail earlier granted to Chief Nwaukoni would remain in effect pending the next adjournment.
The repeated adjournments and absence of the prosecution have raised concerns over delays in high-profile judicial proceedings, particularly those involving serious charges such as terrorism and attempted murder.
